Art 5 - LEGAL GUARANTEE OF CONFORMITY

Art 5-1 Consumer Rights

All products are covered by the Legal Guarantee of Compliance provided by articles 128-135 of the Consumer Code.

The legal guarantee of conformity is provided for by the Consumer Code (articles 128 et seq.) and protects the consumer in the case of products with defects existing at the time of delivery, i.e. the original defects that appear within 24 months following delivery , while any defects that may occur are excluded (for example if due to use, lack of or bad maintenance, replacement with non-original spare parts, etc.). The consumer can assert his rights regarding the legal guarantee of conformity by contacting the seller of the goods directly, even if different from the manufacturer. In the presence of a lack of conformity, the consumer has the right, at his choice, to have the defective goods repaired or replaced by the seller, without charging any costs, unless the requested remedy is impossible or excessively onerous compared to the other. If replacement or repair is not possible, the consumer still has the right to a price reduction or to receive a sum back, commensurate with the value of the goods, upon returning the defective product to the seller. To take advantage of the legal guarantee, the burden of proof is distributed between seller and consumer, based on when the defects appear. For defects of conformity that appear within one year of delivery of the goods, the burden of proof will lie with the seller, who must demonstrate that the goods were fully compliant, i.e. that the defect complained of by the consumer occurred after delivery. If, however, the defects appear one year after delivery, the consumer will have to provide proof that the defect was already present at the time of delivery. The legal guarantee lasts two years from delivery of the goods and must be asserted by the consumer within two months of discovering the defect.

Art 5-2 Terms
The consumer waives the rights of Article 5-1 if he does not report the compliance defect to the seller within two months of the date he discovered the defect
